Terms of Service

1. Agreement to these Terms

These Terms of Service (the "Terms") are a binding agreement between you and Fork & Spoon, a sole proprietorship (eenmanszaak) established in the Netherlands at Voorstraat 44, 5334 JV Velddriel, registered with the Dutch Chamber of Commerce (KvK) under number 42137788 ("Fork & Spoon", "we", "us").

The Terms govern your use of the Fork & Spoon mobile and web application (the "App"), the website forkandspoon.app and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and confirm you have read the Privacy Policy. If you do not agree, do not use the Service.

If you obtained the App through the Apple App Store or Google Play, the additional terms in §14 also apply.

2. Eligibility

You may use the Service only if you are at least 13 years old (16 in the EEA/UK, or the minimum digital-consent age in your jurisdiction) and can lawfully enter into this agreement, or you have your parent's or guardian's consent. We may refuse, suspend or terminate accounts at our reasonable discretion, in particular to comply with law or to protect the Service and other users.

3. Your account

You need an account for most of the Service. You can sign up with e-mail, Sign in with Apple or Google Sign-In. Provide accurate information, keep your credentials confidential, and report unauthorised access promptly to support@forkandspoon.app. You can delete your account at any time from Profile → Settings → Delete my account.

4. The Service, and how it may change

Fork & Spoon lets you store, organise and share recipes and cookbooks; import recipes from URLs, photos and YouTube videos; plan weekmenus and generate shopping lists; share content with your household or cooking buddies; and use AI features for recipe generation, recipe images, reading ingredients from a photo, ingredient substitution suggestions and sorting your shopping list.

The Service is provided "as is" and "as available", and it evolves. We may add, change, limit or remove features, integrations and AI models; introduce or change quotas, credit costs and fair-use limits; change supported devices and OS versions; and swap the providers we route requests through. AI usage costs and third-party APIs are outside our full control, so this flexibility is a fundamental part of how the Service works.

If we materially reduce a core paid feature of your active subscription, we will notify you in the App and by e-mail before the change takes effect, and you can cancel your subscription before it does.

We may amend these Terms. We will announce material changes at least 14 days in advance in the App and by e-mail; continued use after the effective date constitutes acceptance.

5. Subscriptions and billing

Fork & Spoon offers a free tier with limited functionality and paid plans that unlock AI features and larger quotas, as described on the pricing screen at the time of purchase.

Subscriptions are sold and billed by Apple (App Store) or Google (Google Play), not by us; entitlements are managed via RevenueCat. Subscriptions renew automatically at the disclosed price unless you cancel at least 24 hours before the end of the current period, via your App Store or Google Play subscription settings.

Trial terms (duration, included credits) are disclosed before you start a trial. If you do not cancel before the trial ends, the regular price is charged. Trial credits do not roll over.

Refunds are handled by Apple and Google under their policies; we will support reasonable requests where we can. EU/EEA consumers: for digital content you expressly agree that performance begins immediately upon purchase and acknowledge that you thereby lose your 14-day right of withdrawal once delivery has begun (Art. 16(m) Directive 2011/83/EU). This does not affect your statutory remedies for non-conformity.

We may change prices for future billing periods; Apple or Google will notify you and, where required, ask your consent before charging the new price.

6. AI features — important disclosures

You acknowledge and agree that:

• AI features generate content that can be incorrect, incomplete or misleading — including recipes that omit allergens, suggest unsafe quantities or describe unsafe techniques. Always verify ingredients and methods before cooking.
• Fork & Spoon is not a medical, nutritional, allergen-safety or food-safety service, and AI output is not professional dietary or medical advice.
• AI-generated images are illustrative and may not depict the actual dish.
• We may log AI prompts and outputs for abuse prevention, quality and safety, as described in the Privacy Policy.
• AI features are metered: credits have no monetary value, cannot be exchanged for cash, and may expire or be adjusted as described in §4.
• We may apply abuse-prevention measures such as rate limiting, content filtering and refusing requests.

7. Your content

"Your Content" means recipes (including imported or AI-assisted ones), photos, notes, shopping lists, weekmenu entries and other material you submit. You retain all rights in Your Content; we claim no ownership.

You grant us a worldwide, non-exclusive, royalty-free licence (sublicensable to the service providers listed in the Privacy Policy) to host, store, reproduce, transmit, display, adapt and process Your Content, solely to operate, secure and improve the Service — including syncing across devices, transforming images for delivery, sending content to AI providers when you use AI features, and showing it to people you share with. The licence ends when you delete Your Content or your account, except for backup copies (deleted on the schedule in the Privacy Policy) and content you have shared with others.

We do not use Your Content to train third-party foundation models, and our AI providers are prohibited from doing so.

You warrant that you have the rights needed to submit Your Content and that it does not infringe third-party rights or applicable law. When you import a recipe from a URL, video, photo or external database, you are responsible for complying with the source's terms and copyright law.

8. Sharing, households and cooking buddies

You can share recipes or cookbooks via e-mail invitations or share links, join a household, and connect with cooking buddies. When you share, you authorise us to make the relevant content visible to those people: household members can see content shared within the household (such as shopping lists, weekmenus and cookbooks), and accepted buddies can see what you share with them. You can revoke access, leave a household or remove a buddy at any time in the App. Share links are unguessable, but anyone holding a valid link can view the shared recipe in a read-only web view. Recipes already saved by others remain in their collection after you revoke access or delete your account.

9. Acceptable use

You agree not to:

• use the Service in violation of law or third-party rights, or submit unlawful, infringing, hateful or sexually explicit content;
• use AI features to generate illegal or harmful content;
• bypass quotas, credit metering, paywalls or rate limits, or share an account to circumvent per-user limits;
• scrape, batch-export or systematically copy data, or use the Service to build a competing product or train a machine-learning model;
• reverse-engineer the App except as permitted by mandatory law;
• introduce malware, perform load attacks or probe for vulnerabilities without authorisation — security findings are welcome at security@forkandspoon.app.

10. Intellectual property

The Service — software, design, trademarks and content other than Your Content and third-party content — is owned by Fork & Spoon or its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial use.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for material breach of these Terms or serious legal risk, or if we cease operating the Service (with reasonable notice and a pro-rata refund for paid subscribers, processed where possible via Apple or Google). Sections that by their nature survive (§§ 6, 7, 10, 12, 13, 15) survive termination.

12. Disclaimers

To the extent permitted by applicable law, the Service is provided without warranties of any kind. We do not warrant that AI-generated recipes are safe to eat, allergen-free or accurate — always verify before cooking — nor that the Service is available in your country or compatible with future OS versions, and we are not responsible for third-party content we link to or import from.

Nothing in this section excludes liability that cannot be excluded under mandatory consumer-protection law. EU/EEA consumers retain all mandatory statutory rights, including the remedies for non-conformity of digital content.

13. Limitation of liability

To the extent permitted by applicable law, our aggregate liability is limited to the greater of (a) the amount you paid for the Service via Apple or Google in the 12 months preceding the event and (b) EUR 100, and we are not liable for indirect or consequential damages, lost profits, lost data or business interruption.

Nothing in this section limits liability that cannot be limited under applicable law, including liability for intent or gross negligence, death or personal injury caused by our negligence, or mandatory consumer rights.

14. App Store and Google Play terms

If you obtained the App from the Apple App Store: these Terms are between you and Fork & Spoon, not Apple; Apple has no maintenance or support obligation; upon failure of the App to conform to an applicable warranty you may notify Apple and Apple will refund the purchase price; Apple is not responsible for product, IP or consumer-protection claims relating to the App; Apple and its subsidiaries are third-party beneficiaries of these Terms; and you represent that you are not located in a country subject to a US government embargo.

If you obtained the App from Google Play, Google's Play Terms of Service apply in addition.

15. Governing law and disputes

These Terms are governed by Dutch law. If you are a consumer, you additionally benefit from the mandatory consumer-protection rules of your country of residence and may bring proceedings before the courts of your place of residence. For non-consumers, the District Court of Gelderland (rechtbank Gelderland), the Netherlands, has exclusive jurisdiction.

16. Miscellaneous

• Entire agreement. These Terms, the Privacy Policy and any plan-specific terms shown at purchase form the entire agreement.
• Severability. If a provision is unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver.
• Assignment. We may assign these Terms to a successor in a merger, acquisition or sale of assets.
• Notices. We may give notices in the App, by e-mail or on the Website.
• Language. The English version prevails over translations, except where mandatory law of your country requires otherwise.
